1. General Disclaimer

The information, content, and Products provided on the PartsZote platform (www.partszote.com) are offered on an "as is" and "as available" basis. While PartsZote endeavours to ensure the accuracy, completeness, and reliability of all information published on the Platform, we do not warrant or make any representations regarding the accuracy, reliability, or completeness of any content, materials, or Products on the Platform.

Your use of the Platform and any reliance upon its informational content is at your sole risk. With respect to the Platform's informational content and availability, PartsZote disclaims warranties of completeness, accuracy, and uninterrupted access, to the maximum extent permitted by the laws of the Republic of Kenya. This disclaimer applies to informational content and platform availability only, and does NOT apply to Products sold through the Platform. Products purchased through the Platform are subject to the statutory warranties set out in the Terms & Conditions, including those implied by the Sale of Goods Act (Cap 31) and the Consumer Protection Act, 2012. Nothing in this Disclaimer excludes or limits any warranty, condition, or guarantee implied by the Sale of Goods Act (Cap 31) or the Consumer Protection Act, 2012 in relation to Products purchased through the Platform.

PartsZote reserves the right to modify, update, or remove any content on the Platform at any time without prior notice.

2. Product Information & Fitment

PartsZote provides product specifications, descriptions, and vehicle fitment information based on industry-standard vehicle databases, manufacturer catalogues, and supplier data. This information is intended to assist Buyers in identifying the correct parts for their vehicles.

However, PartsZote cannot guarantee 100% compatibility for every vehicle and part combination. Factors that may affect fitment accuracy include:

Vehicles manufactured during model-year transitions, where specifications may have changed mid-production.
Vehicles imported from markets with different specifications (e.g., a European-spec vehicle versus a Middle Eastern or Japanese-spec vehicle of the same model).
Vehicles that have been modified, upgraded, or fitted with non-standard components.
Variations in original equipment manufacturer (OEM) part numbers across production batches or regional variants.

Buyer Responsibility: Before placing an order, Buyers should verify compatibility by checking their vehicle's VIN (Vehicle Identification Number), confirming the OEM part number of the part being replaced, or consulting a qualified mechanic. PartsZote's customer support team is available to assist with fitment verification upon request.

3. Product Images

Product images displayed on the Platform are provided for illustrative purposes only and may not be an exact representation of the actual Product. Differences may arise due to:

Screen settings and colour calibration on your device.
Changes in Product packaging by the manufacturer.
Minor design or cosmetic variations between production batches.
Use of generic category images for certain Product types.

Buyers should rely on Product specifications, part numbers, and descriptions rather than images alone when making purchasing decisions. Where a discrepancy exists between an image and the Product description or specifications, the written description and specifications shall prevail.

4. Pricing

All prices on the Platform are displayed in Kenya Shillings (KES) and are subject to change without prior notice. While PartsZote takes reasonable care to ensure that prices listed on the Platform are accurate, errors may occasionally occur.

In the event of a pricing error:

If the correct price is lower than the listed price, PartsZote will charge the lower amount and dispatch the Order.
If the correct price is higher than the listed price, PartsZote will contact you before processing the Order to inform you of the correct price. You will have the option to confirm the Order at the correct price or cancel the Order for a full refund.
PartsZote reserves the right to cancel Orders that are affected by obvious pricing errors (for example, a product listed at KES 10 instead of KES 10,000), regardless of whether the Order has been confirmed.

PartsZote will not cancel a confirmed Order due to a pricing error if doing so would unfairly prejudice the Buyer, particularly where the Buyer has acted in good faith. In all cases, the Buyer will be offered a full refund as an alternative.

Promotional prices, discounts, and special offers are valid for the stated duration only and are subject to availability. PartsZote reserves the right to modify or withdraw promotions at any time.

5. Third-Party Links

The Platform may contain links to third-party websites, services, or resources that are not owned or controlled by PartsZote. These links are provided for your convenience and informational purposes only.

PartsZote does not endorse, warrant, or assume responsibility for the content, accuracy, privacy policies, or practices of any third-party websites. Your access to and use of third-party websites is at your sole risk and subject to the terms and conditions of those websites. PartsZote encourages you to review the terms and privacy policies of any third-party website before providing personal information or conducting transactions.

6. Professional Advice

PartsZote is an automotive parts marketplace, not a mechanical repair service or automotive consultancy. Information provided on the Platform, including product descriptions, fitment guides, installation notes, and blog content, is for general informational purposes only and does not constitute professional mechanical advice.

PartsZote strongly recommends that all automotive parts be installed by a qualified, licensed mechanic or automotive technician. Incorrect installation of automotive parts can result in:

Damage to the vehicle or its components.
Compromised vehicle safety and performance.
Voiding of the manufacturer's warranty on the part.
Personal injury or property damage.

PartsZote accepts no liability for any loss, damage, or injury arising from the installation or use of Products by unqualified individuals or in a manner inconsistent with the manufacturer's installation guidelines.

7. Availability

All Products displayed on the Platform are subject to stock availability. While PartsZote strives to maintain accurate stock levels, availability may change between the time a Product is added to your cart and the time your Order is confirmed.

If a Product becomes unavailable after you have placed an Order, PartsZote will notify you promptly and offer the following options:

A full refund for the unavailable Product.
A suitable alternative or equivalent Product at a comparable price, subject to your approval.
A backorder with an estimated restocking date, if you are willing to wait.

PartsZote shall not be liable for any delay, inconvenience, or consequential damages resulting from Product unavailability.

8. Limitation of Liability

To the fullest extent permitted by the laws of Kenya:

PartsZote shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Platform or the purchase, installation, or use of any Product, even if PartsZote has been advised of the possibility of such damages.
Without limiting the foregoing, PartsZote shall not be liable for: vehicle downtime; costs of towing, rental vehicles, or alternative transportation; loss of revenue or business opportunity; costs associated with removing an incorrect or defective part and installing a replacement; or damage to other vehicle components caused by an incompatible or defective part.
PartsZote's maximum liability for any claim arising under or in connection with these Terms, any Product, or your use of the Platform shall be limited to the amount you paid for the specific Product that is the subject of the claim.

The limitations and exclusions set out in this section shall apply regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise, and shall survive any termination of these Terms. Nothing in this section excludes liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under Kenyan law.

9. Force Majeure

PartsZote shall not be liable for any failure or delay in the performance of its obligations under these Terms or any Order to the extent that such failure or delay is caused by circumstances beyond PartsZote's reasonable control, including but not limited to:

Natural disasters, floods, earthquakes, epidemics, or pandemics.
Acts of war, terrorism, civil unrest, or government action.
Strikes, labour disputes, or work stoppages.
Interruptions in supply chain, transportation, or telecommunications infrastructure.
Power outages or failures in internet or telecommunications networks.
Changes in law, regulation, or government policy that materially affect PartsZote's ability to perform.

In the event of a force majeure occurrence, PartsZote will use reasonable efforts to mitigate the impact and resume performance as soon as practicable. If a force majeure event continues for more than thirty (30) days, either party may terminate the affected Order(s) upon written notice, and PartsZote will issue a full refund for any undelivered Products.

10. Governing Law

This Disclaimer and all matters arising from or related to the Platform and its content are governed by and shall be construed in accordance with the laws of the Republic of Kenya. Any disputes arising in connection with this Disclaimer shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

If any provision of this Disclaimer is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
